Mr. Trump just declared by tweet that the amendments to the INA of 1965, passed by Congress and signed by then President Johnson -- do. not. exist. That is, those amendments clearly state that the President does not have the power to restrict immigration based on "nationality" (they say the same about religion, and race -- but tonight Mr. Trump recasts his order(s) in the form of country bans). As such, Mr. Trump commits himself, and publicly so, to a ban based on. . . nationality, when he bans a country. Here is the tweet, in full:

That's right, we need a TRAVEL BAN for certain DANGEROUS countries, not some politically correct term that won't help us protect our people!. . . .
Mr. Trump has thus declared that he has the power to undo Acts of Congress, with a stroke of his pen (by simple executive order). He has no such power. [And that is if we simply ignore that the ends of his order are themselves unconstitutional establishments of disfavored religions.] He loses. 9-0, in the US Supreme Court, and soon. [11-0 or 12-0 overall, when the dust settles.] So much theater; so little of use -- so little thought. So Trumpian.
