Flores Federal Immigration Practices Class Action Litigation: Looks Increasingly Likely To Settle, On Terms Favorable To ACLU -- With Mr. Biden Now Calling All The Shots...


The Flores litigation will begin to wind down (again!) now, as what has been very active litigation for four years -- but having been an open federal class action for over 36 years, on and off (in truth, mostly only active when the GOP controls the White House, and the resulting federal immigration policies contravene well-settled law) and the ACLU and others find willing, good faith defendants (as opposed to the prior obstructinists!), on the other side -- post January 20, 2021. So, the able USDC Judge Dolly Gee, and Dana Sabraw, and Jon Tigar, may all soon see their dockets return to some semblance of lawful, rational. . . normalcy.

From the latest, more hopeful meet and confer request, then -- after 200 often contentious filings in the year 2020, alone (this will finally start winding down):

. . .In light of the new Administration, Plaintiffs are seeking a meet and confer with the Defendants as promptly as reasonably possible with the participation of the Special Master to explore and attempt to resolve all issues relating to the FSA and FSA compliance. The Court has frequently urged the parties to meet and confer and develop solutions to compliance short of motions and Court Orders, and the new Administration may be inclined to agree. . . .


If it gets interesting enough, I may live blog tomorrow's 11 AM (Pacific) status hearing. It might well see the withdrawal of Sarah Fabian, and perhaps. . . others. I'll be listening in. And of course, grinning. . . widely.
