[U] Muslim Ban 3.0: "Death Throes" Edition -- The Preliminary Injunction Out Of Maryland Has Been Appealed By 45 To The Fourth Circuit...


Just a pair of rather smallish Monday updates, at dawn (under drenched skies): in Hawaii, the parties have all consented to the TRO being recast as a preliminary injunction, by the able Judge Watson, so that there may be no question that 45 may appeal the entry of that injunction immediately to the Ninth Circuit -- which I expect he will do yet this coming week.

Toward the end of last week, his lawyers appealed to the Fourth Circuit -- on the preliminary injunction out of Maryland's District Courts -- as signed by the very-able Judge Theodore Chuang. And so, both cases will be in the same postre by this week's end.

And thus, I expect that in about six months, both should reach the Supremes again -- and by then, Trump will likely be at least 0 for 17 on the merits. He may lose a few more trial level cases, in between, but I will stay focused on the headline cases -- the cases that had reached the Supremes, on cert. once before.

Now you know -- on to a productive and joyous week of. . . birthday -- to celebrate! Dinner mystery, playing the role of Daniel H. Burnham, on Friday night -- in a partially derivative, but professionally-sponsored "Devil in the White City" night of harrowing fun. Great pre-Halloween fare, indeed -- and a sublimely macäbrə celebration!

UPDATED: 10.24.2017 @ 10 AM EDT -- As predicted, 45 has appealed the Hawaii preliminary injunction to the Ninth Circuit overnight:

Indeed -- and I grinned in wonder when I read that the traffic to the site crashed the server there.

That is an encouraging sign: it will never garner the level of vapid Kim/Kanye traffic, but it is garnering really solid numbers. . . I feel more hopeful, about the future generations of scientists. . . because of that.
