The NY Post (I know!) is running an interview with, and a picture of Fosamax® Juror No. 5. Clearly, Juror No. 5 must have consented to being photographed, and identified -- but I'll not run it here. You may see it there, if you are so inclined. In any event, her account of the pressures inside the jury-room certainly lends credence to my earlier hunch that one juror was effectively intimidating a mostly "silent majority":
. . . ."There were e-mails that Merck knew about these effects since 1999 and they weren't putting any warnings on the drugs," said [Juror No. 5]. "On the first day of deliberations, [the other jurors] were sure Merck was right. . . .
But [Juror No. 5] blamed the "poisonous" environment mostly on juror No. 6. "Nobody had a right to do anything but what this guy wanted," she said. . . .
Indeed -- A "Runaway Jury" scenario. . . .
