[U X5] No Comment. At Just A Moment Of Cell Coverage, Here On Lake Champlain.


A majority of the United States Supreme Court previously ruled that he is entitled to a full due process hearing, before anything else is done with regard to his immigration status. That hearing is to take place in a federal courtroom, not an ICE detention center.

Any attempt to move him out of this country is therefore wrongful -- without a full and prior United States District Court hearing before a real judge who makes a determination that he's deportable, despite the fact that he holds paperwork entitling him to remain in the United States. This holding is grounded in his Fourteenth Amendment rights, and his Sixth Amendment right to counsel -- because he is entitled to be here, and he is presently on United States soil. I will not be able to track day-to-day updates on this clown show being run by the Noemites, so you'll need to watch The New York Times closely -- but here's the latest:

. . .Kilmar Armando Abrego Garcia, the immigrant who was wrongfully deported to El Salvador in March and returned home to Maryland, arrived for an immigration check-in on Monday in Baltimore and was taken into ICE custody, according to his lawyer. The immigration authorities did not say why he was being detained or where he was taken, the lawyer said. . . .


As we've previously said, there is also a US District Court order out of Tennessee, which prevents ICE/DHS from limiting his access to his counsel, when / if he is detained. He is now detained. Thus, any move to take him out of the United States would be a direct violation of that federal court order.

Update: USDC Judge Xinis has (again) ruled that he may not be moved outside the continental United States, and his counsel must be notified as to his current whereabouts -- to allow access to his right to consult with counsel.
