[U (05.05.2023): More Being Added, Daily...] There Will Likely Be Four Dozen "Amici" Briefs, In The Fifth Circuit Filed, Now -- Given The High Stakes In The Mifepristone / FDA Suit -- Out Of Texas...


Updated @ 10 am EDT on 05.05.2023 -- here on Friday morning, about nine new briefs came in -- I will stop tracking them, even in the aggregate now -- but it will likely be over 60 now. This very afternoon (and this is only a partial listing, below), the Fifth Circuit in New Orleans granted dozens of parties and entities leave to file so-called "friend of the court" briefs, to weigh in on how extraordinarily wrong-headed Judge Matthew Kacsmaryk's mifepristone order was (on a drug approved for over two decades, by FDA without interruption -- and safer than Tylenol) -- of a month ago.

By far, the majority of the briefs do argue that the young judge had no authority to enter the sweeping order he did. But there will be a smattering of briefs arguing the so-called "Comstock Act" claim was proper. That argument will fall. Here though is a real reflection of just how important this issue has become: normal appeals may see one -- or at most two amici -- many will never see even one of them.
