This very afternoon (and this is only a partial listing, below), the Fifth Circuit in New Orleans granted dozens of parties and entities leave to file so-called "friend of the court" briefs, to weigh in on how extraordinarily wrong-headed Judge Matthew Kacsmaryk's mifepristone order was (on a drug approved for over two decades, by FDA without interruption -- and safer than Tylenol) -- of a month ago.

By far, the majority of the briefs do argue that the young judge had no authority to enter the sweeping order he did. But there will be a smattering of briefs arguing the so-called "Comstock Act" claim was proper. That argument will fall. Here though is a real reflection of just how important this issue has become: normal appeals may see one -- or at most two amici -- many will never see even one of them.
