As to the Slate item, then: I think the author is well-intentioned, but mis-informed.
In an appeal on mandamus, using procedural arguments -- since this is a procedurally defective mandamus petition. . . is a wise choice, for at least two reasons.
First, appeals panels love to be able to dispose of knotty questions on procedural grounds -- and this is one where the trial judge hasn't ruled on anything. Highly irregular. So I think Wilkerson's arguments against mandamus at this early point. . . will be well-received.
Second, if the panel does grant mandamus, trial court Judge Emmet Sullivan may then appeal that ruling right back upstairs, to another panel.
Two bites at the apple, there. Rather than winner take all.
A little more darkly / prosaically -- and, I think honestly -- some of this is slyly to slow things down -- so Trump cannot pardon Flynn. . . hopefully, November comes, and Trump is out. . . before a final decision is handed down from the Supremes, on Flynn's case.
