It seems clearer thinking has prevailed. As a practical matter, this keeps abortions available in Texas, during COVID-19 pandemic flattening orders [ones Texas Governor Abbott used, in part, to try to stop abortions].
It is now unlikely the Supremes will need to act on this record:

The ruling by the three-judge panel expressed “serious concerns” about whether the district court had sufficiently considered, for example, the “emergency public health measures” that prompted the executive order by Texas Governor Greg Abbott. . . .
