Update: From The Merck v. Merck Status Conference Call/Hearing, Today...


More likely to come -- after the March 19 response is on file.

Maybe we are getting closer to a global settlement. Who knows? They clearly continue to talk settlement -- see the first sentence, below:

. . . .TEXT ORDER: As discussed on the record on March 5, 2019, the parties will continue to meet and confer on the resolution of this matter generally, and the resolution of the witness dispute that was raised at the March 5, 2019 telephone conference. On or before March 12, 2019, Plaintiff shall inform the Court and defense counsel whether the witnesses at issue are located within this Court's subpoena power.

Defendant shall file any response by March 19, 2019. If the parties' meet-and-confer efforts warrant an extension of the the March 12th and March 19th deadlines, they shall so notify the Court and seek an extension. There will be a telephone conference in this matter on March 26, 2019, at 4:00 p.m., which Plaintiff will kindly initiate. So Ordered by Magistrate Judge Michael A. Hammer on 3/5/2019. . . .
