[U] Stay Of Discovery Lifted In NYED Federal Propecia® MDL Yesterday


[Obvious error corrected; I have no excuse. Michael Cooper pointed out the title spoke of the wrong drug -- but the graphic was correct -- my haze here is in evidence.] It should be noted that even as late as mid-December 2016, this site was still using a graphic which suggested a September 2017 first bellwether trial date. That time line will no longer hold. The federal (USDC Brooklyn) MDL first bellwether will likely go to trial in March of 2018 -- a month ahead of the state (NJ MCL) first bellwether.

Here is the Brooklyn USDC July 2017 order, called PPO No. 15, with the expedited deadlines (I can't recall whether I've actually linked to the full order before, so there it is), followed by the able judge's minute order, of yesterday:

. . . .Expert Depositions. All expert depositions must be completed by November 6, 2017.

. . . .Motions. All motions to exclude or limit expert testimony pursuant to Federal Rule of Evidence 702 and all dispositive motions shall be filed as follows:

a. Opening Briefs: November 27, 2017;

b. Opposition Briefs: December 27, 2017; and

c. Reply Briefs: January 10, 2018.

If necessary, the Court will hold a hearing to consider these motions on a date to be determined later. Total briefing for each parties’ Daubert briefs shall be limited to 50 collective pages per side for opening briefs, 50 collective pages per side for opposition briefs, and 25 pages per side for reply briefs. . . .

Trial Schedule. The Court anticipates that the First Bellwether Tranche shall be trial ready by March 2018. . . .

MINUTE ORDER 09/26/2017

The parties were to advise the Court by 9/20/2017 regarding the stay of discovery. As no party put in a letter, the stay of discovery is hereby lifted, and the parties are ordered to adhere to the [above] expedited deadlines set in PPO 15 (Third Amended), entered on 7/11/2017.

In my haze, I captioned this as being about finasteride, but it is about alendronate sodium. Thanks to Michael Cooper, on the back up site -- for gently correcting me overnight.
