Merck/Gilead Post Trial Arguments Now Set For September 7, 2017 In Wilmington, Delaware


Overnight, the very able federal District Court Judge Leonard P. Stark, sitting in Delaware -- on this high stakes patent spat (now with a nominal verdict of $2.54 billion in damages, in favor of Kenilworth) -- rescheduled the post trial argument date, just as we said he would.

Here's the full text of his oral order, from the bench:

. . . .ORAL ORDER: Having reviewed the parties' joint status report (D.I. 574). . . .

IT IS HEREBY ORDERED that the hearing scheduled for August 31 is RESCHEDULED for September 7, 2017, beginning at 10:00 a.m.

Each side will be allocated two (2) hours for its presentation and each side shall be prepared to argue all pending motions, other than Idenix's motions for ongoing royalties and other royalties (see D.I. 538 at 17-23), as the parties' joint request to stay these latter motions (see D.I. 574 at 1) is GRANTED.
