Lone Pine Order Deadline Is Monday -- For "Atypical" Fosamax® Plaintiffs With Names J Through R


I've now thrice mentioned these looming Lone Pine deadlines -- on January 18, and February 22 and 28, 2013 -- right here.

The second deadline -- for J through R named plaintiffs -- arrives on Monday at 4:30 p.m. Eastern. This is an entirely unaffiliated public service announcement -- offered solely to keep any truly injured person from losing their rights, here.

So, if any US Fosamax® plaintiff is claiming a "non-typical" injury from Fosamax (i.e., not jaw bone death, or ONJ as it is sometimes called), Monday of this coming week is the last day to have your lawyer(s) submit a doctor's report to the court, averring to the non-typical injury -- for all plaintiffs whose last names begin with a J through R.

These reports must cover, among other things, evidence from a doctor as to whether the doctor believes to a reasonable degree of medical certainty that Fosamax caused the alleged injury, and if so, the factual and medical/scientific bases for that opinion.

And as a reminder, plaintiffs with last names S through Z must so submit by June 20, 2013. A few plaintiffs lawyers have filed motions to extend the time period for their clients, but thus far, none have been granted.  I have seen one or two denied -- in the PACER electronic filing system, thus far. So, do check in with your lawyer, if you are reading this, and your name falls in the listed range.
