Peter Loftus Shows Excellent Balance, For The WSJ -- Reporting the (Smallish) Settlement News, of Today. . . .

Excellent! Do go read all of Peter Loftus' latest, on the announcements I analyzed earlier today, but here is a snippet, of his coverage, from about 20 minutes ago:

. . . .A U.S. Department of Justice investigation is still pending, as are lawsuits alleging securities-law violations. . . .

In addition, Merck and Schering waited nearly two years after Enhance was completed to release the results, which led to accusations that the companies purposely delayed the release because they knew the study was negative and would hurt sales. The companies have said data-quality problems with the study required repeated analyses, and that top company officials didn't know the results until shortly before they were released. . . .

Still, more and bigger Vytorin settlements could be in the works. In September 2008, Merck received a letter from the Justice Department saying it was investigating whether the companies' promotion of Vytorin caused false claims to be submitted to federal health-care programs; the companies are cooperating with the probe. The companies also have received letters from congressional committees seeking information about their handling of the Enhance trial. . . .

One small clarification, when reading Mr. Loftus' fine coverage -- he mentions the merger-related litigation as still pending, but I think, in fact, the suits against Schering-Plough, related to the merger, are now under an agreement in principal -- to settle. I do believe the suits against Merck (essentially that it overpaid for Schering-Plough) are still open and unresolved. If I am wrong about that I will correct it here later -- the merger claims against Merck are also subject to an agreement, in principal, to settle, dated July 24, 2009.
