As we've said repeatedly before, the goofy government lawyers for Tangerine cannot simply tell a USDC Judge she isn't doing what they want "fast enough" -- and appeal upstairs, speciously alleging a "constructive denial" [BTW, there is no such thing, at federal habeas law, in the US, as to the federal government actors].

So now the case returns to the capable USDC Judge Xinis -- likely to grant Mr. Abrego Garcia a permanent habeas order -- and dismiss the government outright. We shall see:

Upon consideration of submissions relative to appellees’ motion to dismiss for lack of jurisdiction the portion of the government’s appeal that purports to challenge the “constructive denial” of two motions to dissolve an injunction, the court grants the motion. . . .
