Chief Justice Roberts Is... The "Nouveau" Kennedy Vote... "Sit Down, Donald" Edition.


Just as we repeatedly predicted, the Supremes just declined to give Trump his extra-ordinary request of an immediate stay -- to the nationwide preliminary injunction entered against his lawlessness, in East Bay Sanctuary, out of the Ninth Circuit, and the San Francisco federal district courts.

Not surprising -- and we are glad to read that "The Notorious" RBG is cancer free, and healing nicely!

. . . .The application for stay presented to Justice Kagan and by her referred to the Court is denied.

Justice Thomas, Justice Alito, Justice Gorsuch, and Justice Kavanaugh would grant the application for stay. . . .


Just "go smock (sic) that, Mr. Tangerine Mussolini!" So -- next up is a return to the district court, for full trial on permanent injunction -- unless Trump capitulates (again!), as he did in Ms. L.'s cases, in the San Diego federal district court, on October 5, 2018.

Grinning ear to ear, here. . . . Everyone home by tomorrow night. . . .

I am having a hard time digesting the level of lunacy -- offered by hard right wing lawyers, no less -- on the Supremes' order, above. I always read their reactions (primarily to be sure I am not missing anything); but almost never comment on them. But this time, I'll make an exception.

This lawyer clearly has read 8 USC § 1158(a)(1). He knows what it means. He knows it is controlling, positive federal law. And yet, he closes his remarks. . . as follows:

. . .The proliferation of nationwide injunctions issued by federal courts has hampered the Trump administration’s efforts to address the continuing crisis at our southern border. . . .

8 USC § 1158(a)(1) directly and unambiguously prohibits the unlawful Trump attempted actions -- so they are. . . enjoined. We are a nation of laws, afterall.

He might as well argue that the laws against murder "are hampering" Trump's efforts to shoot someone dead (with a "smocking" gun, no less) in the middle of Fifth Avenue, and get away with it. "Scott Free" (Heh).

He goes on to blame the courts, while saying (rightly) that legislation is the responsibility of the Congress. The level of his Renfield-esque self-deception (though his is likely intentional, not lithium derived) here is. . . staggering.

Onward -- but do go see the Twitter "Goodnight Moon" parodies, on this shutdown -- the third this year. A record. Well done, Donnie!
